To demonstrate our further commitment to online privacy, LexisNexis is a licensee of the TRUSTe® Privacy Program. TRUSTe is an independent organization whose mission is to build users’ trust and confidence in the Internet by promoting the use of fair information practices. TRUSTe’s certification covers the Web sites gathering and dissemination of information not any services or products. We have disclosed the information practices of our Web site to TRUSTe, and TRUSTe has reviewed and approved our online privacy practices for compliance with TRUSTe’s online privacy standards.
If you do not receive acknowledgment of your inquiry or your inquiry has not been satisfactorily addressed, you should then contact TRUSTe at http://www.truste.org/consumers/watchdog_complaint.php. TRUSTe will then serve as a liaison to resolve your concerns.
INFORMATION COLLECTION
I. Personally Identifiable Information
Personally identifiable information (“PII”) collected from you through the Site may include, for example, name, mailing address, e-mail address, User ID and password, any responses you choose to provide to survey questions, information provided in connection with subscribing to a newsletter, or any inquires you may make through the Site. We do not share, sell, rent or trade that PII with third parties for their promotional purposes.
For organizations that have contracted with us for LexisNexis Firm Manager® services, we also may collect personal information that is considered confidential “Customer Information” or “Customer Data” as defined in your agreement for the use of the Services provided via the Site (the “Agreement”), This Customer Information and Customer Data is used and disclosed in accordance with your organization’s Agreement. In the event of any differences between this Online Privacy Policy and your organization’s Agreement, the Agreement will govern how we handle your Customer Information and Customer Data.
II. Cookies
“Cookies” are small pieces of information that are stored by your browser on your computer’s hard drive. The Site uses first and third party cookies; however PII is not collected through the use of cookies. Cookies are used to assist us in managing your visit to the Site.
While most browsers are set to accept cookies by default, you can set yours to refuse cookies or to alert you before accepting them. Your browser manufacturer has information on changing the default setting for your specific browser.
III. Nonpersonally-identifiable Information
The Site also collects non-PII. For example, as you browse the Site we may collect information about your visit, but not about you personally. Via Web server logs, for example, we may monitor statistics such as: the number of people that visit the Site, which page(s) are visited on the Site, from which domain our visitors come (e.g., aol.com, hotmail.com, etc.), and which browsers people use to visit the Site (e.g., Apple Safari, Microsoft Internet Explorer, etc.) and we may use this information for purposes such as identifying and analyzing trends regarding the usage of the Site. The Site also may use outsourcing programs to assist us in analyzing this data to better tailor the Site.
INFORMATION USE AND CONSUMER CHOICE
The information collected by the Site is used only for responding to your inquiries and otherwise corresponding with you, for processing transactions you request, maintaining your account (if you have one), for other purposes permitted by your organization’s customer agreement(s) (if any), and for the administration, review and/or the improvement of the content of the Site. As noted in the Personally Identifiable Information Section, above, information that is confidential under your Agreement (including Customer Data and Customer Data) will be used in accordance with the terms of the Agreement.
We may contact you in response to your comments or inquiries, as part of the maintenance of your account with us (if you have one), or in order to complete a transaction that you requested.
We may also contact you to inform you of other products or services we believe may be of interest to you, but we will offer you an opportunity not to receive such communications. If you decide that you do not want to receive further e-mails regarding your inquiry from LexisNexis, you can reply to the e-mail or use the opt-out mechanism provided in the e-mail with a request that we not continue to e-mail you.
If you choose to use our referral service to tell a friend about the Site or a particular product or service, we will ask you for your friend’s name and e-mail address. We will automatically send your friend a one-time e-mail message with information about the product or service and/or inviting him or her to visit the Site. This message may include your name and/or e-mail address and any optional message that you elect to send along with our e-mail. We do not retain the information that you provide as part of this referral service (although we may retain your friend’s e-mail address if he or she requests to receive additional information or e-mail messages from us).
ONWARD TRANSFER
We may disclose information you provide to us to third parties in order to complete a transaction that you request or as otherwise permitted by your Agreement(s) (if any).
We may also outsource some tasks, including the operation of certain web site functions that require access to information you supply online and information about your visits to the Site. In such cases, however, we require that the companies acting on our behalf institute safeguards to protect the confidentiality of your information.
If our company or our assets are acquired by another company, that company will assume responsibility for the personal information collected by us through the Site and it will assume the rights and obligations regarding the information collected through the Site, as described in this Online Privacy Policy.
We may disclose personal information when required by law or in the good faith belief that such action is necessary to comply with the law or legal process.
As noted in the Personally Identifiable Information Section, above, information that is confidential under your Agreement (including Customer Data and Customer Data) will be disclosed only in accordance with the terms of the Agreement.
ACCESS AND CORRECTION
As an information company, we know the importance of accurate data. Therefore, we strive to maintain the accuracy of the Customer Information collected through the Site. We will provide you with access to PII you provide through the Site for as long as we maintain that information in a readily accessible format. Similarly, we permit and encourage you to correct inaccuracies in the information you submit to us through the Site.
If you wish to access information that you have submitted through the Site or to request the correction of any inaccurate information you have submitted through the Site, please use the mechanisms provided by the Site or send an e-mail to: privacy.information.mgr@lexisnexis.com.
The access and correction provisions of this Online Privacy Policy only apply to PII collected from you through the Site (other than information which is considered “Customer Data” if you have entered into an Agreement, which your organization may access and correct through the Site).
SECURITY
We take steps to protect against the loss, misuse, or unauthorized alteration of PII collected through the Site. We recognize the importance of security for all PII collected by the Site.
Once we receive PII, we take steps to protect its security on our systems. We limit access to PII to those employees who need such access in order to carry out their job responsibilities.
OTHER WEB SITES
This Online Privacy Policy only applies to the web site(s) identified in the first paragraph of this Online Privacy Policy. The Site, however, may include links to other web sites which may be operated by other LexisNexis companies or by third parties. In order to better serve our consumers and their privacy interests, certain products within LexisNexis may also be governed by their own privacy policies separate from this Online Privacy Policy. If you visit a web site not listed above, we recommend that you review the online privacy policy of that web site to determine how the operator of that web site will handle PII collected through that web site.
POLICY CHANGES
We may revise this Online Privacy Policy from time to time. If we make any material changes to this Online Privacy Policy, the date of the most recent revision will be indicated above so that you can determine whether there have been any material revisions since your last visit.
